Overview

Welcome to MSP Vintage. The terms “we,” “us,” and “our” refer to MSP Vintage.

These Terms of Service govern your access to and use of our website, online store, products, content, features, and related services. By visiting our website, creating an account, or placing an order, you agree to these Terms of Service, our Privacy Policy, Return and Refund Policy, and Shipping, Delivery and Pickup Policy.

Please review these policies before making a purchase. If you do not agree with them, you should not use our website or services.

1. Eligibility and Account Information

By using our website, you represent that you are at least the age of majority in your state or place of residence.

You agree to provide accurate, current, and complete information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your account information and for activity conducted through your account.

We reserve the right to refuse service, cancel orders, or terminate accounts when we reasonably believe that information is inaccurate, payment is unauthorized, fraud is suspected, or these Terms have been violated.

2. Vintage and Secondhand Products

MSP Vintage primarily sells vintage, antique, secondhand, and previously owned merchandise. Unless expressly stated otherwise, products are sold in their existing vintage condition and should not be expected to appear or perform like new merchandise.

Signs of age and previous use may include:

Scratches, scuffs, dents, chips, fading, discoloration, staining, patina, finish wear, repairs, replaced components, and other imperfections.
Wear to upholstery, cushions, rugs, textiles, wood, metal, glass, plastic, leather, and other materials.
Variations in color, texture, construction, dimensions, and finish.
Odors or evidence of previous storage or use.

We do our best to inspect, photograph, measure, and describe each item accurately. However, minor imperfections, previous repairs, condition issues, or other details may occasionally be missed. The absence of a specific condition note does not mean that an item is flawless or in new condition.

Please carefully review all photographs and descriptions before purchasing. We strongly encourage customers to ask questions or request additional photographs, videos, measurements, or condition information before completing an order.

3. Product Descriptions and Photographs

We make reasonable efforts to present our products accurately. However, colors and finishes may appear differently depending on lighting, photography, screen settings, and the device used to view the website.

Measurements are approximate and may vary slightly depending on where and how an item is measured. Customers are responsible for confirming that an item will fit its intended space, doorway, stairway, elevator, vehicle, or delivery route.

Props, artwork, plants, accessories, and other items shown in styled photographs are not included unless specifically identified as part of the product listing.

Descriptions involving a designer, manufacturer, material, country of origin, age, or production period are based on available labels, markings, provenance, construction details, research, and comparable examples.

Terms such as “attributed to,” “in the style of,” “manner of,” “after,” “possibly by,” and similar language express an informed opinion and are not guarantees of authorship, manufacturer, age, or origin.

4. Upholstery, Lighting and Electrical Items

Vintage upholstery, cushions, rugs, and textiles may contain fading, compression, discoloration, minor staining, repairs, odors, or other evidence of previous use. Professional cleaning or reupholstery may be appropriate depending on the customer’s preferences.

Vintage lighting and electrical items may contain original or older wiring and may not meet current electrical or building standards.

A statement that a light or electrical item is “working” means only that it powered on during a basic test. It is not a warranty of continued operation, electrical safety, or compliance with current codes.

We recommend having vintage electrical items inspected and, when appropriate, installed or rewired by a qualified professional before use. Light bulbs are not guaranteed and may not be included.

5. Orders and Order Acceptance

Submitting an order constitutes an offer to purchase. An order is not considered accepted until payment has been successfully processed and we have confirmed the order.

We reserve the right to refuse, limit, or cancel an order for reasons including:

An item selling through another sales channel before inventory could be updated.
A pricing, description, inventory, or website error.
Previously undiscovered damage or condition issues.
Inability to safely fulfill or ship an order.
Suspected fraud or unauthorized payment.
Violation of these Terms or our other store policies.

If we cancel an order after payment has been processed, we will refund the amount paid for the canceled item and any related unperformed services.

Please review your order carefully before submitting it. Cancellation requests are not guaranteed after an order has been accepted, packed, scheduled for delivery, or released for shipment.

6. Pricing, Payment and Taxes

All prices are shown in U.S. dollars unless otherwise stated.

Prices may change without notice before an order is completed. The price charged will be the price displayed when the order is submitted, subject to correction of obvious errors.

Prices generally do not include shipping, delivery, packing, storage, taxes, duties, or other service charges unless specifically stated.

Applicable sales tax will be collected where required. Customers are responsible for customs duties, import taxes, brokerage fees, and similar charges associated with orders shipped outside our normal service area.

Promotions and discounts cannot be applied retroactively to previously completed purchases unless expressly stated.

You represent that you are authorized to use the payment method provided and that the payment and billing information submitted is accurate.

7. Shipping and Delivery

Items specifically marked as eligible for shipping may be shipped using the available checkout method or through a separately arranged shipping quote.

Items that are not marked as shippable are considered local-pickup items by default. Please email info@mspvintage.com before purchasing if you would like to ask about shipping or delivery.

Depending on the item and destination, we may be able to arrange parcel shipping, freight, white-glove delivery, local delivery, or another transportation option. Shipping availability is not guaranteed for every item.

Processing and delivery dates are estimates unless expressly guaranteed in writing. We are not responsible for carrier delays, weather delays, customs processing, missed appointments, or other events outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. Additional charges caused by an incorrect address, failed delivery attempt, refused shipment, inaccessible location, or required redelivery are the customer’s responsibility.

Additional shipping, delivery, and damage-claim terms are provided in our Shipping, Delivery and Pickup Policy, which forms part of these Terms.

8. Customer-Arranged Shipping

Customers may arrange transportation through their own shipper, mover, courier, freight company, delivery service, or other representative.

The customer is responsible for:

Selecting and paying the transportation provider.
Confirming that the provider is properly equipped for the item.
Arranging packing, crating, blanket wrapping, loading, insurance, and delivery services.
Providing the shipper with correct dimensions and pickup information.
Coordinating a pickup appointment with MSP Vintage.

We will make reasonable efforts to coordinate with the selected provider. However, we are not responsible for loss, damage, delays, missed appointments, or service issues involving transportation arranged by the customer.

Responsibility for the item transfers to the customer when the item is inspected and released to the customer’s selected shipper or representative. Claims involving buyer-arranged transportation must be handled directly with that provider.

9. Local Pickup

Local pickup is available by appointment. Pickup instructions will be provided after purchase.

Customers are responsible for arriving with an appropriately sized vehicle and any blankets, straps, tools, packing materials, or additional labor needed to transport the item safely. Loading assistance may be limited.

Customers or their representatives should inspect items at pickup. Responsibility for an item transfers to the customer once it is removed from our possession.

Pickup deadlines, storage charges, and terms for uncollected merchandise are provided in our Shipping, Delivery and Pickup Policy.

10. Returns, Refunds and Exchanges

Because our inventory primarily consists of vintage, preowned, and one-of-a-kind merchandise, all sales are final.

We do not accept returns or exchanges or provide refunds or store credit for:

Changes of mind.
Fit, scale, or measurement issues.
Color or finish differences.
Normal vintage wear.
Minor imperfections.
Disclosed condition issues.
Details visible in listing photographs.
Customer-arranged shipping damage.
Personal preferences regarding appearance, comfort, odor, patina, or condition.

Please contact us within 48 hours of delivery or pickup if you receive the wrong item, an item is materially different from its listing, or an item shipped through a carrier arranged by us arrives damaged.

Claims must include the order number and clear photographs of the item, packaging, shipping label, and reported issue. All packaging must be retained until the claim has been resolved.

Do not return, repair, alter, discard, or dispose of an item without written authorization from MSP Vintage.

11. Installation and Use

Customers are responsible for determining whether a product is appropriate and safe for its intended use.

Customers are also responsible for proper transportation, assembly, installation, anchoring, mounting, maintenance, repair, and professional inspection when appropriate.

This is especially important for lighting, electrical products, mirrors, shelving, wall-mounted objects, glass components, tall furniture, and products used around children or pets.

MSP Vintage is not responsible for damage or injury caused by improper transportation, installation, mounting, assembly, modification, maintenance, or use.

12. Website Content and Intellectual Property

The content of our website—including our business name, logo, product descriptions, photographs, graphics, videos, designs, and written materials—is owned by or licensed to MSP Vintage and is protected by applicable intellectual-property laws.

You may use our website for personal, noncommercial shopping purposes. You may not copy, reproduce, distribute, modify, republish, sell, commercially exploit, or create derivative works from our content without prior written permission.

13. Third-Party Services and Links

Our store is hosted by Shopify and may use third-party services for website hosting, payment processing, shipping, analytics, and other business functions.

Your use of certain third-party services may be subject to the terms and privacy policies of those providers.

Our website may contain links to third-party websites. We are not responsible for the availability, accuracy, security, practices, products, or content of third-party websites. Accessing or purchasing from a third-party website is at your own discretion and risk.

Questions or disputes involving a third party’s independent products or services should be directed to that provider.

14. Prohibited Uses

You may not use our website or services:

For any unlawful, fraudulent, abusive, or malicious purpose.
To violate applicable laws or the rights of another person.
To submit false or misleading information.
To impersonate another person or entity.
To transmit viruses, malicious code, spam, or unauthorized advertising.
To interfere with the operation or security of the website.
To collect another person’s information without authorization.
To scrape, reproduce, resell, or commercially exploit website content without permission.
To harass, threaten, defame, or abuse MSP Vintage, its representatives, or another customer.

We may restrict or terminate access to the website when we reasonably believe these Terms have been violated.

15. Errors and Omissions

Our website may occasionally contain typographical errors, pricing errors, inaccurate descriptions, incorrect shipping charges, inventory discrepancies, or other omissions.

We reserve the right to correct or update information and to cancel affected orders, including after an order has been submitted. If an affected paid order is canceled, we will issue a refund for the canceled item and any related unperformed services.

16. Disclaimer of Warranties

To the fullest extent permitted by law, our website, services, and products are provided on an “as-is” and “as-available” basis.

Except where expressly stated in writing, MSP Vintage makes no warranties or representations, express or implied, regarding merchantability, fitness for a particular purpose, durability, continued operation, safety, authenticity, or non-infringement.

We do not guarantee that the website will always be uninterrupted, secure, error-free, or available.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

17. Limitation of Liability

To the fullest extent permitted by law, MSP Vintage and its owners, employees, agents, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from:

Use of or inability to use our website.
Purchase, possession, transportation, installation, or use of a product.
Carrier delays, loss, or damage.
Reliance on website content or product information.
Unauthorized access to customer information.
Improper installation, repair, alteration, or use of an item.

Where liability cannot legally be excluded, our total liability will not exceed the amount paid to MSP Vintage for the product or service giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be limited or excluded.

18. Indemnification

You agree to indemnify and hold harmless MSP Vintage and its owners, employees, contractors, agents, and service providers from third-party claims, damages, losses, liabilities, and reasonable legal expenses resulting from:

Your violation of these Terms.
Your unlawful use of the website or products.
Your violation of another person’s rights.
Your improper transportation, installation, modification, resale, or use of a product.

19. Privacy

Personal information collected through our website is handled in accordance with our Privacy Policy.

By using the website or placing an order, you acknowledge that information may be processed by Shopify, payment processors, shipping providers, analytics services, and other service providers necessary to operate the store and fulfill orders.

20. Termination

We may suspend or terminate access to our website or services if we reasonably believe that a customer has violated these Terms, committed fraud, abused our services, or engaged in unlawful conduct.

Any payment obligations and provisions that by their nature should continue after termination will remain in effect.

21. Severability and Waiver

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the greatest extent permitted and the remaining provisions will continue in effect.

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

22. Entire Agreement

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping, Delivery and Pickup Policy, and any other policies posted on our website, constitute the entire agreement between you and MSP Vintage regarding use of our website and purchases made through it.

23. Governing Law

These Terms and any separate agreements with MSP Vintage are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles.

Any legal proceeding relating to these Terms or our services must be brought in a court of competent jurisdiction located in Minnesota, except where applicable law requires otherwise.

24. Changes to These Terms

We may update these Terms periodically by posting a revised version on our website.

Changes become effective when posted unless applicable law requires additional notice. Continued use of the website after the effective date constitutes acceptance of the revised Terms.
